Official Rules
NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW.
BY ENTERING THE CONTEST, EACH ENTRANT AGREES TO BE BOUND BY THESE OFFICIAL RULES.
- Eligibility: The Gerber Family-Friendly Restaurant Fund Contest (the "Contest") is open only to owners that are at least 18 years old, legal residents of the 50 United States or District of Columbia, and own licensed bars or restaurants that are open to the public and operating within the 50 United States or District of Columbia who: (a) are an independent family-owned restaurant or bar that owns three (3) or less restaurants or bars; (b) have an up-to-date business license; (c) have up-to-date and adequate insurance coverage; (d) be able to implement the upgrades, if selected as a winner, within one (1) year of receiving the Prize evidenced by entering into a payment term agreement with Sponsor; and (e) if selected as a winner, demonstrate an interest in adopting at least two or more of the following improvements or selecting/building their Sponsor-approved “parent-friendly wish list” to make their establishment more parent-friendly on game day (i) Installation of highchairs and/or booster seats; (ii) Access to changing tables in restrooms; (iii) A designated family or kid-friendly seating area; (iv) A baby or toddler-friendly menu (must cater to children ages 1 to 4 years of age); (v) Noise-buffering accommodations or kid-safe zones; and (vi) Broadcast of family-safe programming alongside game coverage (collectively, an “Eligible Establishment” or “Eligible Entrant”). Void where prohibited by law. Employees of Gerber Products Company, 1812 N Moore Street, Arlington, Virginia 22209 (the "Sponsor"), Brandmovers, Inc., 1519 Carroll Dr NW, Atlanta, GA 30318 ("Administrator”), (collectively, the Sponsor and Administrator are hereinafter referred to as "Released Parties”), Nestlé USA, Inc., and any of their respective affiliates, subsidiaries, advertising agencies, or any other company or individual involved with the design, production execution or distribution of the Contest and their immediate family (spouse, parents and step-parents, siblings and step-siblings, and children and step-children) and household members of each such employee are not eligible to enter or win. The Contest is subject to all applicable federal, state and local laws and regulations. This Contest is not open to the general public. This contest is not open to any chain restaurant or bar owners. Participation constitutes the Eligible Entrant’s full and unconditional agreement to these Official Rules and Sponsor's decisions, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.
- Contest Periods:
The Contest consists of the following three (3) periods:
- The entry period begins on September 23, 2025, at 12:00:01 AM Eastern Time (“ET”) and ends November 2, 2025, at 11:59:59 PM ET (the “Entry Period”); and
- The finalist judging period will begin on November 3, 2025 and end on November 10, 2025 (“Finalist Judging Period”); and
- The Grand Prize judging period will begin on November 11, 2025 and end on November 18, 2025 (“Grand Prize Judging Period”).
- How to Enter. To enter the Contest, Eligible Entrants can visit https://familyfund.gerber.com (“Website”) during the Entry Period (defined in Official Rule #2(a) above) to find, complete and submit the following: (a) the online entry form, by providing the first and last name, email address of the Eligible Establishment’s contact person, the Eligible Establishment’s business name and address, and a brief description of the Eligible Establishment (“Entry Form”); (b) an up to 1000 word essay regarding your proposed parent-friendly improvements you plan to make to your Eligible Establishment if you are deemed a winner (the “Essay”); (c) up to four (4) photos of your Eligible Establishment (“Photos”) (the Entry Form, Essay and Photos are collectively hereinafter referred to as a “Submission”). All Submissions must be received by 11:59:59 PM ET on November 2, 2025, to be eligible for the Contest. Sponsor is not responsible for any technical issue relating to the entry, including any issues with uploading the Submission. Limit one (1) Submission per Eligible Establishment during the entire Entry Period.
- Submission Entry Requirements:
Eligible Entrants agree to and understand
that the Essay (or portions thereof), name of the Eligible Establishment and Photo
portions of the Submissions may be made available to the public, including
without limitation, posting on the Internet and may appear in Sponsor’s
advertising and marketing materials. Whether or not Submissions are published
on the Internet, Sponsor does not covenant or guarantee any confidentiality with
respect to any Submissions.
- The Essay portion of the Submission must not have been submitted previously in any Contest of any kind or exhibited or displayed publicly (i.e., disclosed beyond your immediate circle of friends and family) through any means previously.
- The Submission must be an original creation of the Eligible Entrant submitting it, which is under no restriction, contractual or otherwise, that will prevent Sponsor's use of the Photos or Essay which each must be free of any and all liens, encumbrances and claims of third parties. Eligible Entrant acknowledges, agrees and warrants that, nothing in the Photos or Essay infringes on any copyrights, confidential information, trade secrets or trademarks belonging to any person or entity other than the Eligible Entrant (absent a suitable license, clearance or permission agreement and proof of which is required upon submission), or violates any person's rights of privacy or publicity and that all necessary release and permissions have been secured. Eligible Entrant agrees to indemnify and hold harmless each of the Released Parties and their respective parents, subsidiaries, and affiliates and each of their respective officers, directors and employees, from and against any and all claims, demands, damages, costs, liabilities and causes of action of whatsoever nature that are based upon or arise out of any breach by Eligible Entrant of these Official Rules or the warranties and representations made by the Eligible Entrant in this paragraph. Modifying, enhancing or altering a third party's preexisting work does not qualify as an original creation.
- By uploading the Submission the Eligible Entrant agrees, for zero compensation, to grant to Sponsor, its agents, licensees and assigns, a non-revocable, worldwide, perpetual license to the Photos and Essay, which rights include, without limitation, the Sponsor's right to publish, make available to the public and/or reproduce the Photos and Essay through any media available at any time during, or after, the Entry Period on any related websites, in any promotional materials, whether related or un-related to the Contest, and at any other location, whether physical or online, that Sponsor, in its sole discretion, deems appropriate and necessary for the operation and promotion of this Contest, and without limitation, and without additional review, compensation, or approval from Eligible Entrant. Eligible Entrant agrees to release, defend, indemnify and hold harmless each of Released Parties, and each of their parent, subsidiaries, and affiliates and each of their respective owners, employees, directors, officers, agents, and subcontractors from all claims, demands, and causes of action of any nature whatsoever which Eligible Entrant or their heirs, representatives, executors, administrators, or any other persons acting on Eligible Entrant’s behalf or on behalf of Eligible Entrant’s estate, have or may have by reason of: (i) Sponsor's exercise of any rights granted in this paragraph; (ii) claims based on violation of any right of publicity or rights of personality, infringement of copyright or trademark, libel, slander, defamation, invasion of privacy, loss of earnings or potential earnings in connection with Sponsor's use of the Photos and/or Essay and any portion thereof, or the likeness of any natural person therein.
- By submitting a Submission, you represent and warrant that your Submission
complies with all requirements in these Official Rules and that you have all the
rights necessary to grant Sponsor the rights to your Submission described
hereunder. Further, by entering you indicate your agreement to these Official
Rules and Sponsor’s decisions regarding the Contest, which are final and
binding. Winning a prize is contingent upon fulfilling all requirements in these
Official Rules.
Submission Content Restrictions
Submissions must not contain material that:
- Contains or depicts someone smoking or intoxicated;
- Violates or infringes another's rights, including without limitation, privacy, publicity or intellectual property rights, or that constitutes copyright infringement;
- Contains material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
- Contains any unacceptable clothing or adornments, or displays any commercial/corporate advertising other than that of Sponsor (including but not limited to corporate logos, brand names, trademarks, slogans, political, personal and religious statements);
- Contains indecent or unsafe behavior or situations, profanities or obscenities, including but not limited to nudity, or pornography, or is otherwise inappropriate, indecent, profane, obscene, hateful, tortuous, slanderous or libelous;
- References persons or organizations without their written permission;
- Disparages any persons or organizations;
- Includes threats to any person, place, business, or group;
- Is unlawful, in violation of or contrary to all applicable federal, state, or local laws and regulations.
- Judging of Submissions:
- Finalist Judging During the Finalist Judging Period, all eligible Submissions received during the Entry Period will be judged by an independent judging panel comprised by Administrator judges, using the following judging criteria and percentages: (a) the proposed enhancements to the Eligible Establishment as described in the Essay and how they match the theme of the Contest (40%); (b) the description of how the proposed enhancements to the Eligible Establishment will optimize game day fun for both parents and their little ones (50%); and (c) how well the Essay is written and clarity of the Photos (10%) (“Finalist Judging Criteria”). The top twenty (20) highest scoring Submissions using the preceding Finalist Judging Criteria will be deemed the Finalists, who will move on to the Grand Prize round of judging. In the event of a tie, the Submission with the highest score in the description of how the proposed enhancements to the Eligible Establishment will optimize game day fun for both parents and their little ones criteria will be deemed the Finalist from among all tying Submissions. In the event not sufficient Submissions received during the Entry Period in this Contest, Sponsor and/or Administrator reserve the right to select fewer than twenty (20) Finalists in this Contest. Finalists will NOT be notified they are a Finalist.
- Grand Prize Judging: During the Grand Prize Judging Period, all eligible Finalist’s Submissions will be judged by an independent judging panel comprised by Sponsor judges, using the following judging criteria and percentages: (a) the proposed enhancements to the Eligible Establishment as described in the Essay and how they match the theme of the Contest (49%); (b) the description of how the proposed enhancements to the Eligible Establishment will optimize game day fun for both parents and their little ones (51%) (“Grand Prize Judging Criteria”). The top six (6) highest scoring Finalist Submissions using the preceding Grand Prize Judging Criteria will be deemed the potential Grand Prize winners (subject to eligibility verification and background checks and/or Eligible Establishment due diligence as described in Official Rule #6 below). In the event of a tie, the Finalist’s Submission with the highest score in the description of how the proposed enhancements to the Eligible Establishment will optimize game day fun for both parents and their little ones criteria will be deemed the potential Grand Prize winner from among all tying Finalists. In the event there are not sufficient Submissions received during the Entry Period in this Contest, Sponsor reserves the right to select fewer than six (6) Grand Prize winners in this Contest.
- Notification of Potential Grand Prize Winners:
Sponsor or Administrator will
contact the potential Grand Prize winner on or about November 19, 2025, via
email and/or telephone to verify the eligibility and begin the background check
and/or due diligence process. Sponsor/Administrator will make up to three (3)
attempts to contact the potential Grand Prize winner over a period of three (3) business days beginning on November 19, 2025, and ending on November 24,
2025. In the event the Sponsor/Administrator are not able to reach the potential
Grand Prize winner to verify eligibility and obtain the necessary information to
conduct the background check and/or Eligible Establishment due diligence, that
winner forfeits their right to the Grand Prize, and the next highest scoring
Finalist using the Grand Prize Judging Criteria above will be selected as an
alternate potential Grand Prize winner. Sponsor will contact that potential
alternate Grand Prize winner on the day they are selected as the alternate, and
Sponsor/Administrator will make up to three (3) attempts to contact that
potential alternate Grand Prize winner. In the event the Sponsor/Administrator
cannot reach the potential alternate Grand Prize winner, that winner forfeits
their right to the Grand Prize, and the next highest scoring Finalist using the
Grand Prize Judging Criteria above will be selected as an alternate potential
Grand Prize winner. This process will continue until six (6) potential Grand Prize
winners are reached.
Then, each potential Grand Prize winner will be required to provide proof to Sponsor’s satisfaction of the Eligible Establishments eligibility (per the requirements listed in Official Rule #1), and provide the Sponsor and/or Administrator the Eligible Establishments federal tax identification number (“EIN”). Each potential Grand Prize winner will be asked to have an authorized representative of the Eligible Establishment complete, sign and return within five (5) days an Affidavit of Eligibility; a Release of Liability; a Publicity Release; a W9; written permission for Sponsor to conduct a background check (as discussed in more detail in the paragraph below) and/or conduct due diligence about the Eligible Establishment; and the Payment Agreement (collectively, the “Documentation”). Failure to complete the Documentation as required may result in potential Grand Prize winner’s disqualification, at Sponsor’s sole discretion and selection of an alternate Grand Prize winner based on the next highest score in the Grand Prize Judging Criteria as set forth above.
In addition, by being named a Grand Prize winner, and in consideration for receiving the Grand Prize, each Grand Prize winner agrees upon accepting the Grand Prize that it will (1) use the Grand Prize to make the upgrades or enhancements (“Enhancements”) featured in the winning Submission; (2) make all such Enhancements within twelve (12) months of being named an official Grand Prize winner (the “Enhancement Term”); and (3) it will provide Sponsor with regular updates of the Enhancement process along with supporting photographs and/or videos, not less than 3 times during the Enhancement Term. By accepting the Grand Prize, the Grand Prize winner hereby grants Sponsor a perpetual, irrevocable, editable, worldwide license and right to use the updates, photographs, videos of the Enhancement process (as provided by Grand Prize winner) on Sponsor’s social media platforms, as well as feature these materials in other marketing and promotional materials at Sponsor’s sole discretion without any additional compensation or approval from the Grand Prize winner, as more fully set forth in the Payment Agreement enter into by the Grand Prize winner and Sponsor. - Background Checks/Due Diligence Permission:
Each potential Grand Prize
winner hereby authorizes Sponsor and its designated agents and representatives
to conduct a comprehensive review of potential Grand Prize winner’s background (the “Background Check”). In addition, each potential Grand Prize winner hereby
authorizes Sponsor and its designated agents and representatives to conduct a
comprehensive review of the potential Grand Prize winning Eligible
Establishment, such as looking for any prior health code violations,
discriminatory practices, or other legal actions taken against the Eligible
Establishment (“Due Diligence”) that poses a reputational risk to Sponsor. As
such, potential Grand Prize winners understands that they will be asked to
provide a social security number of the Eligible Establishment’s owner, or similar
identification number, addresses or residences from the last seven (7) years, date
of birth, prior names (e.g. maiden name) and any other information necessary for
Sponsor to conduct a Background Check of the Eligible Establishment’s owner.
The scope of the Background Check may include, without limitation, civil and
criminal history records from any criminal justice agency in any or all federal and
state records, sex offender registry check, and terrorist watch list check. In
addition, potential Grand Prize winners understand that they will also be asked to
provide a federal tax identification number of the Eligible Establishment to assist
Sponsor in its Due Diligence process. Each potential Grand Prize winner agrees
in order to be eligible to be deemed an official Grand Prize winner, it must provide
all personal and Eligible Establishment-related information needed for Sponsor
to conduct the Background Check and Due Diligence as set forth above, and
agrees to sign releases or authorization forms as part of the Documentation in
order to permit Sponsor to conduct the Background Check and Due Diligence.
Sponsor and its designated agents and representatives shall maintain all
information received from this release and authorization form in a confidential
manner in order to protect potential Grand Prize winner’s Eligible Establishment
and the Eligible Establishment owner’s personal information.
Sponsor reserves the right, in its sole discretion, to disqualify a potential Grand Prize winner for any of the following reasons: (a) non-compliance with these Official Rules; (b) in the event that the potential Grand Prize winner notification is returned as undeliverable; (c) Background Check or Due Diligence, or other information indicating a history, characteristic or quality considered by Sponsor to be unacceptable in a potential Grand Prize winner in this Contest; (d) information showing that the Eligible Entrant and/or Submission failed to comply with these Official Rules. - Prizes and Approximate Retail Values (“ARVs”) – Six (6) Grand Prize –
$25,000.00, to be paid to the winning Eligible Establishment in the form of
multiple checks, to be used to upgrade or make the enhancements as proposed in
the winner’s Submission and as set forth in the Payment Agreement entered into
by the winning Eligible Establishment and Sponsor. The Grand Prize is to be paid
out to the winning Eligible Establishment as set forth in the Payment Agreement.
ARV: $25,000.00 each. The total ARV of all Grand Prizes is $150,000.00.
Prizes are non-transferable and not substitutable. Prizes will be awarded to the Eligible Establishment and not to any individual, including but not limited to, the owner of the Eligible Establishment. Sponsor may substitute the prize for one of equal or greater value at Sponsor’s sole discretion for any reason. Winners will be responsible for paying all applicable local, state and federal taxes associated with accepting the Grand Prize. A 1099 form will be submitted to all appropriate taxing authorities. The winners must meet the eligibility requirements as set forth in Paragraph 1 of these Official Rules. - Claiming the Prizes: Upon receipt of the Documentation and completion of winner verification (including Sponsor’s acceptance of Background Check and Due Diligence results), and receipt of the final fully executed Payment Agreement, Sponsor will provide the Grand Prize to the winner in accordance with the terms of the Payment Agreement. Sponsor and Administrator are not responsible for lost, late, delayed, damaged, stolen, mutilated, or technical glitches associated with the mailing or emailing of any Prize or Documentation. All unclaimed or returned Prizes remain the property of Sponsor.
- Participation Conditions/Release/Consent to use Likeness: By participating, each Eligible Entrant agrees to: (a) comply with and be bound by these Official Rules and the decisions of the Sponsor which are binding and final in all matters relating to this Contest; (b) release and hold harmless the Released Parties from and against any and all claims, expenses, and liability, including, but not limited to, negligence and damages of any kind to persons and property, including, but not limited to, invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant's participation in this Contest, and acceptance or use or misuse of prize; (c) indemnify, defend and hold harmless the Released Parties from and against any and all claims, expenses, and liabilities (including reasonable attorney’s fees) arising out of or relating to an Eligible Entrant's participation in the Contest and/or Eligible Establishment's acceptance, use or misuse of the Grand Prize; and (d) allow Sponsor’s use for promotional purposes the Photos submitted in the Submission, and any other photos, images, and likeness created by Sponsor or its representatives upon being named the Grand Prize winner without any additional compensation.
- General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Contest, or any part of it, for any reason whatsoever, including, without limitation, fire, flood, natural or man-made pandemic or epidemic of health or other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis, order of any court or jurisdiction or if any fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Contest, as determined by Sponsor in its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the participation process or the operation of the Contest or to be acting in violation of these Official Rules or any other Contest or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Only the type and quantity of Grand Prizes as described in these Official Rules will be awarded. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
- Limitations of Liability: The Released Parties as set forth above are not responsible for: (1) any incorrect or inaccurate information, whether caused by Eligible Entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited, to malfunctions, interruptions or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the participation process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of phone calls, emails or texts; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Eligible Entrant's participation in the Contest or receipt or use or misuse of any Grand Prize.
- Privacy Policies and Data Collections: Information provided by you for this Contest on the entry form, including is subject to Administrator’s Privacy Policy: http://www.brandmovers.com/legal/privacy; or Sponsor’s privacy policy: https://www.gerber.com/privacy-policy as applicable. By entering this Contest, each Eligible Entrant agrees that the Sponsor and/or Administrator has the right to contact the Eligible Entrant by phone, direct message, or email accounts provided on the Entry Form to administer and fulfill this Contest. Notwithstanding the foregoing, except where prohibited, by submitting a Submission in this Contest, your participating acts as your consent to Sponsor’s use of your name and Submission elements for promotional purposes in any media now known or hereinafter developed, without further payment, approval or consideration, in perpetuity.
- Disputes/Governing Law: Eligible Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Contest, other than those concerning the administration of the Contest or the determination of winners or for any disputes arising from the loss or injury from the accepting a Prize, shall be resolved individually, without resort to any form of class action; (ii) any disputes arising out of these Official Rules (except for any disputes arising from the loss or injury from the use of Prizes) shall be submitted to final, binding arbitration conducted in the Commonwealth of Virginia under the Arbitration Rules and Procedures of the Judicial Arbitration and Mediation Services Inc. before a single, neutral arbitrator who is a former or retired Virginia state or federal court judge with experience in entertainment matters who shall follow Virginia law and the Federal Rules of Evidence and have no authority to award punitive damages. Either party may enforce a final arbitration award in any court of competent jurisdiction in Commonwealth of Virginia, including an award of costs, fees and expenses incurred in enforcing the award. Notwithstanding the foregoing, Released Parties shall be entitled to seek injunctive relief (unless otherwise precluded by any other provision of these Official Rules) in the state and federal courts of Commonwealth of Virginia. Any dispute or portion thereof, or any claim for a particular form of relief (not otherwise precluded by any other provision of these Official Rules), that may not be arbitrated pursuant to applicable state or federal law may be heard only in a court of competent jurisdiction in Commonwealth of Virginia; (iii) any and all claims, judgments and awards shall be limited to actual out-of- pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys' fees; and (iv) under no circumstances will Eligible Entrant be permitted to obtain awards for, and Eligible Entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out- of- pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Eligible Entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the Commonwealth of Virginia, without giving effect to any choice of law or conflict of law rules (whether of the Commonwealth of Virginia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Commonwealth of Virginia.
